GOODYS.COM AND GOODY’S APP TERMS OF USE

"GOODY'S SA", based in Spata, Attica (Athens International Airport "El. Venizelos", building 14B) with TIN. 094473860 (hereinafter referred to as "Goody's") created the website www.goodys.com (hereinafter referred to as the "Website") and the corresponding application for smart phones (hereinafter referred to as the "Smart phones app"), with the aim of Electronic ordering of food and beverages and products in general, sold at Goody's stores, either for collection from Goody's partner stores or for distribution at consumer choice points. The use of the Website and the Application as well as the individual services, offered through them, is subject to these Terms of Use, the applicable Privacy Statement and Goody’s Cookies Policy. The use of the Website and / or the Application (even the simple browsing on it) indicates the unconditional acceptance of these Terms of Use and the Privacy Policy by the user, as they apply at all times. The continued use of the Website and / or the Application after modifications to these Terms is construed as acceptance of such modifications.

Goody’s can not guarantee the uninterrupted and without technical errors operation of the Website and / or the Application and assumes no responsibility for the users for any damages resulting from the improper operation or the interruption of access to them.

A. Terms and Conditions of registration

Simple browsing of the Website does not require user registration and personal account creation. The unregistered user of the Website (hereinafter "Guest") will also be able to purchase Goody’s products in addition to browsing by filling out the special order form. However, they will not be able to redeem coupons and gift certificates.

For the full access of the user to the services, provided through the Website and / or the Application, the registration of the user is required by creating a personal account (profile) and the provision of personal information and data as well as the connection with his personal account in each subsequent use of the services of the Website and / or the Application. A condition for the registration and use of the services of the Website is that the user is over 18 years old and has full capacity for legal action.

To create an account, the user declares and registers electronically the data that are systematically required to complete his registration and accepts these Terms, after reading them thoroughly and understanding them, as well as the Privacy Statement https://goodys.com/privacy-policy/ The user can register as a simple member of the site or as a loyalty member.

To create a personal account on the Website and / or in the Application, the user must first enter the following information:

1.His Name.

2. A valid mobile phone number that they legally own. To confirm this number, a secret four-digit numeric code is automatically sent to them via SMS (free of charge for the user), which they must enter on the Website and / or in the Application when requested (two factor authentication). The user guarantees that they are the legal owner and possessor of this mobile phone number and that access to it is under his complete and exclusive control. The user must take appropriate measures to prevent any unauthorized use of this line and acknowledges and accepts that any communication using it is presumed to come from, addressed and received by them.

3. A valid and active e-mail address (‘e-mail’), which has been legally assigned to them. An automated electronic communication message (system email) will be sent to the user at this address, which on the one hand will inform the user about their successful registration and on the other hand will give them basic functions of the Website. The user guarantees that this address is real, that they are the legal beneficiary and user of it and that it is under their complete and exclusive control. The user must take appropriate measures to prevent any unauthorized access and use of his e-mail address and acknowledges and accepts that any communication using this e-mail address is presumed to come from, addressed and received by them.

4. The unique password ("password") that the user selects and enters in the Website and / or in the Application based on the instructions provided to the Website and / or in the Application, in order for the passwords to be valid and acceptable. Goody’s reserves the right to request the user to enter additional information on the one hand as part of the verification and identification process and on the other hand in order to enable the implementation of some of the services provided through the Website and / or the Application. For example, in order to enable the delivery of the ordered goods to the user's point of choice, the user will be asked to provide information about the exact location of the delivery point and access to it, such as postal address, postal code, floor, contact telephone indication indicated on the bell, etc. This information is stored in the user's account and is filled in automatically, so that they do not need to be re-entered by the user in case of future use of the services of the Website and / or the Application. In this way the Website and the Application as well as the services that they provide become more user friendly for them to browse.

To complete the registration, the user must confirm that they have been aware of these terms and that they agree with their content. They should also choose if they want to receive new informative and advertising messages from our company. In case the user does not agree or is not aware of the content of these terms, they will not be allowed to register on the Website and / or the Application respectively, as registration on them requires knowledge and acceptance of the Terms of Use, as applicable.

B. Link to the account and account content

After the successful registration and the creation of a personal account, the user in each subsequent use of the Website and / or the Application will be able to connect with their personal account by entering in the respective fields their username (e-mail address or mobile phone) and their password (secret code), as set out above. As provided above, it is also possible to save and automatically fill in the account access details and certain information, so that the user automatically logs in to their account when browsing the Website and / or the Application and to make shopping easier. In any case and for security reasons, it is recommended to log out of the account after the end of the browsing of the Website and / or the Application.

C. Modification of account details and deletion of account

The user, by logging in to their account, has the right at any time to delete the above information provided, to modify it and to delete the account, which they keep on the Website and / or the Application, following the steps, described in the respective points of the Website and the Application respectively. It is explicitly stated that the deletion of the Account automatically implies the deletion of the user's personal data. For the deletion of their personal data, the user can send the relevant request electronically to info@goodys.com following the relevant instructions that are mentioned in detail in the Privacy Statement. It is also explicitly pointed out that in case the user is a member of Goody’s All Star Club, in case they request its deletion from the Website and / or the Application they will be automatically deleted from the All Star Club Program.

D. Services Provided:

D1. Delivery of goods at the user's point of choice (Delivery)

By selecting the relevant icon with the indication "Delivery", the user can submit their order electronically in order for the ordered goods to be delivered to a point of their choice (if this point is served by Goody’s store). Steps:

- Designation of delivery point: The user will be asked to provide information about the exact location of the delivery point and access to it, such as postal address, postal code, floor, contact telephone, indication on the bell, etc. If the delivery point is served by a Goody’s store, the user will be able to place their order electronically.

- Selection of goods to order: The user will be able to select the products which they wish to order and to configure their shopping cart accordingly. For the distribution of goods at the user's point of choice, the total order must have a minimum cost of six (6.00) euros including VAT and all legal taxes and charges. The minimum order limit may vary due to special circumstances. It is clarified that the cost of € 6.00 of the minimum order should be valid after the implementation of possible discounts and offers. Products that have been included in an order may be found to be in short supply (not available) when the order is placed in the store. The user is informed about any unavailable products in their order by phone and alternatives are offered.

- Method of payment and issuance of a legal tax document: 

1.Cash payment: The user can pay by cash on delivery, that is, paying the price of the transaction exclusively in cash, to the distributor upon delivery of the order.

2. Payment by Credit or Debit Card: The user can prepay (before the delivery of the order) the price of the transaction using their credit or debit card. For the terms that govern electronic payment and the security of electronic transactions, please read carefully the relevant chapter of these Terms ("Electronic Payment & Transaction Security").

3. Payment by Credit or Debit Card   upon delivery: The user can pay the transaction price upon delivery of the order using their credit or debit card.

4. Payment with Ticket Restaurant on delivery: The user can pay the transaction price upon delivery of the order using Ticket Restaurant orders.

Please note that the payment methods available may vary by service store, for example a store may not have a Credit or Debit Card payment  on delivery.

The user can choose the type of legal tax document, which will be issued by the respective  Goody’s store for each transaction.

 - Delivery time point selection: The user can choose either immediate delivery or delivery at a predetermined time / day. Immediate delivery means the delivery of the order within thirty five (35) minutes from the completion of the submission of the electronic order on average. Delivery time may vary by store. The indicative (and non-binding for Goody’s) delivery time will appear on the user's screen. Regarding the delivery at a predetermined time, the user can choose the exact time, reduced to zones of fifteen (15) minutes up to a week later, during which they wish the delivery of the order. The time limits of both immediate delivery and delivery at a predetermined time are indicative, they refer to the average delivery time of the entire network of Goody's stores in Greece at the moment, they may differ in relation to the indicative delivery time indicated on the Website and / or Application, are intended for optimal service and convenience of the user and in no case are binding on Goody's, which bears no responsibility in the event that for any reason it is not possible to deliver the order within the above time limits.

 - Submitting and completing the order: By completing the above steps and selecting the corresponding button-link ("Send Order"), the order is forwarded to the competent Goody's store, whose details (address and contact phone number) are displayed on its screen. user.

 - Cancellation Policy: Cancellations or changes of orders by the user are made exclusively through direct telephone contact with the service store and within a maximum period of fifteen (15') minutes before the indicated indicative delivery time of the order. When the store can not serve due to excessive workload, power outage, technical problem, bad weather or other reasons of force majeure, the user is notified by phone and their order is canceled and if they have debited their credit or debit card to prepay price is informed about the refund process.

D2. Pick up goods from Goody’s store Goodys

By selecting the relevant icon with the indication "Take Away", the user can submit their order electronically in order to receive the goods ordered from Goody’s store of their choice among them, which are listed on the Website and the Application.

Steps:

- Delivery point determination: The user will be asked to select from the list of Goody’s partner stores, displayed on their screen, the store from which they wish to receive their order. For their convenience, a map is provided, which shows the collaborating stores. If the user submits the order for collection from a specific store, it is not possible to subsequently request collection from another Goody’s store.

 - Selection of goods to order: The user will be able to select the products, which they wish to order and to configure their shopping cart accordingly. For the receipt of goods from Goody’s store there is a minimum order cost of € 0.50. Products included in an order may be found to be in short supply (unavailable) when placing the order in the restaurant. The user is informed about any unavailable products in their order by phone and alternatives are offered.

 - Method of payment and receipt and issuance of a legal tax document:

1. Payment upon receipt: The user can pay the price of the transaction in cash or by using a credit or debit card or by ticket restaurant orders, at the cash desk of Goody’s store upon receipt of the order. Payment methods may vary by store.

2. Payment by Credit or Debit Card: The user can prepay online (ie before receiving the order) the price of the transaction using their credit or debit card. For the terms that govern electronic payment and the security of electronic transactions, please read carefully the relevant chapter of these Terms.

The user can choose the type of legal tax document, which will be issued by the respective  Goody’s store for each transaction.

 - Select pick-up time: The user can select either direct pick-up or pick-up at a predetermined time. Immediate receipt means the receipt of the order by the user twenty (20) minutes after sending the online order. The receipt time will appear on the user's screen, resulting from the calculation of twenty minutes from the exact time of sending the order. Regarding the receipt at a predetermined time, the user can choose the exact time, reduced to zones of fifteen (15) minutes up to a week later, during which they wish to receive the order. The deadlines for both immediate and pre-arranged delivery are indicative, are intended to provide optimal service and convenience to the user and are in no way binding on Goody's, which assumes no responsibility in the event that for any reason it does not become the order can be executed within the above time limits.

 - Submitting and completing the order: By completing the above steps and selecting the corresponding button-link ("Send Order"), the order is forwarded to the competent Goody's store, whose details (address and contact phone number) are displayed on the user’s screen. The user is expected to arrive at the same store at the agreed time in order to receive their order. In case of late arrival of the user for receipt, as a result of which there is a risk that the ordered products do not meet all the agreed properties (eg hot food, which has cooled) Goody's store bears no responsibility and the user must fulfill all obligations from the contract of sale, without being able to withdraw or request a replacement. In any case, the store, which executes the order, is not obliged to maintain it after the expiration of 20 minutes from the predetermined time of receipt, in which case it is at its sole discretion to decide how to dispose of it.

 - Cancellation policy: Cancellations or changes of orders by the user are made exclusively through direct telephone contact with the service store and within a maximum period of fifteen (15') minutes before the indicated indicative time of receipt of the order. E. Electronic Payment & Transaction Security

For payment using a credit or debit card during the electronic sending / submission of the order (before receiving the order), only credit and debit cards are accepted, the logo of which appears on the Website and the Application.

All payments, made using a credit, debit and prepaid card, are processed through the Viva Wallet digital online payment platform, which meets the requirements of the PCI-DSS standard for payment card data security. At the same time, during electronic card payments, strong customer identification is applied according to the 3-D secure protocol, in compliance with the European Directive 2015/2366 (PSD2) and the requirements for strong customer identification (Strong Customer Authentication).

F. Personal Data

G. Intellectual Property

The images, logos / marks, graphics, photographs and texts as well as any other element that may be subject to intellectual property rights, located on the Website, are the intellectual property of Goody’s and are protected under the relevant provisions of Greek and EU law. Consequently, any copying, analogue / digital recording and mechanical reproduction, downloading, processing, resale and in general commercial exploitation of the content of the Website and the Application is prohibited.

H. User Responsibility

The user who visits and uses the Website and / or the Application agrees to use it in accordance with the law and good manners.

They undertake not to use the Website and / or the Application for the transmission or retransmission of illegal and / or immoral and / or harmful content in any way, or content and information that infringes any right such as the personality, intellectual and / or industrial property of any third party or contrary to any provision of law or contract.

I. Goody’s Guarantees Goodys - Limitation of Liability

Goody’s, its employees and / or agents are not guaranteed and are not liable for any liability with respect to:

(a) the uninterrupted and defective operation of the Website and / or the Application

(b) the payment of any compensation or expenses or fines, in the event of downtime of the business and / or in the event of use, copying, or presentation of the Website and / or the Application or its contents or any other linked website, regardless of if Goody's knew or should have known about this possibility.

Goody’s is released from any liability for the execution of this in case of force majeure.   

I. Applicable law and Jurisdiction

These Terms and any amendments thereto are governed by Greek Law. For any dispute that may arise from the use of the services, offered through the Website and which can not be resolved out of court, the competent courts of the city of Athens are appointed.
